         When facing a dispute, you may think your only option is to litigate and battle it out in court.  There are other options you can explore.  One of those options is mediation. 

         Mediation is a process that provides a less expensive, less adversarial approach to resolving disputes.  It takes less time and allows the participants to be the decision makers.  The mediation process provides for a neutral, impartial, unbiased third party who does not take sides or make decisions for you.  A mediator guides the process by asking questions and providing information, but all decisions are made by the clients.  Participation in mediation is voluntary and confidential.

  • How many hours of mediation training do you have?  By whom?

  • How many hours of mediation training do you have specific to my type of  case?

  • Do you have training in child development, family law, parenting issues and domestic violence?

  • What percent of your practice is devoted to this type of mediation?

  • What are your fees and hours of operation?

  • Do you carry malpractice insurance?

  • What is your mediation model?

  • What is your role in mediation?

  • How long do you estimate the mediation will take?

  • Do you have a relationship with the other party, their family or business?

  • Can I continuously seek advice from an attorney, therapist or anyone else I think is important?

  • Can I walk away at any time?
